One Typical Israeli War Criminal: Yishai Be'er

Yishai Be’er (or Yishai Bar) was born in 1956. He is married and a father of six children.

Be’er studied Law at Harvard University Law School, and he attended some other law courses in various colleges.

As a jurist, Be’er used his knowledge of the letter of the law to commit, support or cover up grave crimes. He violated the principles of law which he studied and instead implemented talmudic and Israeli military laws, which are racist and inhuman laws. He also implemented the illegitimate laws of the British Mandate which ended on 15 May 1948.

As a soldier, “Be’er” participated in and committed crimes against Humanity, Genocide, and Crimes of War against the civilian populations of Palestine and Lebanon during his military career. Being a jurist and integrant of the special forces makes him an obvious suspect of having participated in or organized the many torture camps of the IDF in southern Lebanon, for example the infamous Khiam, which was bombed by the IDF in 2006 to erase the evidence of their crimes.

Be’er is a well known religious and Zionist extremist member of a fundamentalist Yeshiva in occupied Jerusalem. He studied together with two other Zionist war criminals, his colleagues Major General Elazar Stern, an ultra-Orthodox commander of the Paratroopers Brigade reserve, and Major General Yair Naveh of Golani Brigade at Aryeh Bina’s Meir Rosh Yeshiva High School in occupied Jerusalem. This extremist Yeshiva is directed by Ilana R. Scheiner and financed by the Israeli government and an American Friend of Zionists, Netiv Aryeh.

Be’er legitimized the murder of Palestinian civilians during the second Intifada by the IDF and illegal Jewish colonists, and he also legitimized war crimes against the innocent Lebanese civilian population during the war of 2006. Be’er was the President of the Court of Appeals at the office of the Military Advocate General during the war against Lebanon in 2006.

Be’er was President of the Court of Appeals of the Israeli Forces during five years, until Wednesday 20 April 2007, when he ended his assignment. He was replaced by another war criminal, Brigadier General Shai Yaniv. Yaniv was born in 1956, and he was Be’er’s assistant during his assignment as President of the Court of Appeals of the IDF.

Be’er took part in the operation carried out by Israel commandos at Entebbe Airport in Uganda on July 4, 1976, to release some Israeli hostages who fell in the hands of Palestinian resistance and the German Red Brigades, who were demanding the release of 53 prisoners from Israeli jails.

Bar was a platoon leader during the Entebbe operation, which was also known as the Entebbe Commandos Raid or Operation Thunderbolt. After the operation ended, it was renamed “Operation Yonatan” in memory of the criminal Lieutenant Colonel Yonatan “Yoni” Netanyahu, an Israeli soldier from the Sayeret Matkal commandos and who was killed during the operation. “Yoni” was the brother of Benjamin Netanyahu, the former President of Israel from the extremist “Likud” party. Four hostages were killed and five Israeli commandos were wounded during the operation.

In March 14, 1978 Bar took part in military “Operation Litani”, during which Israel invaded Lebanon from three directions in order to occupy the area of Lebanon south of the Litani river. Be’er was a company commander during this criminal operation in which hundreds of Palestinians and Lebanese were killed. The invasion of Lebanon under the pretext of fighting with the PLO, which then was strongly present in Lebanon, had the only purpose of stealing the water of the Litani river. During the over 20 years of Israeli occupation in Lebanon, millions of cubic meters of water from the Litani river were siphoned off to Israel via an underground pipeline. In this way, in normal years Israel stole 150 million cubic meters of water, in good years the booty was up to 250 million cubic meters. The underground pipeline which Israel used (uses ?) to steal the water of the Litani passes under the villages of Deir Mimas and Kfar Kala and under the Al-Kurdali bridge in southern Lebanon, and ends in Qiryat Shemona, where it joins another underground water pipeline. Currently (2008) the UN and the armed forces of Germany and several other countries help Israel to continue stealing the water from the Litani river, as this forces contingent occupies Lebanon south of the Litani on Israels behalf.

In 1979 Be’er committed war crimes and crimes comprising genocide against the Palestinian people while he served as a company commander and up to the position of a Paratrooper Brigade commander in the occupied Palestinian territories. He is responsible for many assassinations of Palestinians which happened during his assignment.

In 1982 Be’er took part in the Lebanon war as a reserve company commander. During this assignment he committed war crimes against the Palestinian civilian populations of the refugees camps in Lebanon.

In February of 2000 Bar/Be’er was appointed as a commander of the Marine Edom “(Elat) Division”, and received a promotion of rank to Brigadier General.

In May of 2002 Be’er was appointed as President of the Israeli Military Court of Appeals. He used this position to legitimize and cover up numerous grave crimes against Palestinians on part of the IDF and of the illegal Jewish colonists. Be’er/Bar rejected numerous appeals from Palestinians against the demolition of their houses by the IDF, or against illegal “confiscation” orders issued by the IDF against private property of Palestinians, which the IDF would then use as their bases. Bar/Be’er also rejected numerous appeals on humanitarian grounds, in which relatives of Palestinian victims asked the Israeli military court to investigate the murders of Palestinian civilians at illegal Israeli checkpoints, and during the military operations in the cities, towns and villages in the occupied West Bank. The activities of Bar/Be’er as president of the military appeals court constitute crimes of war, crimes against humanity, and are possibly constitutive of genocide.

Bar’s criminal work as a President of the Israeli Military Court of Appeals, and because he covered up for so many crimes of the IDF, gained him a promotion to the rank to Major General. In 2007 Be’er finished his criminal work at the IDF military court. He currently (2008) works as professor of law in the Hebrew University in the occupied Jerusalem.

The obvious questions to ask about Yishai Be’er are:

  • Which law does Be’er teach at the University: the military law, the colonialist laws of the British mandate, or the racist laws of the Talmud as they are taught at the yeshivas, decreeing among other things that Palestinians are less than animals ?
  • What ability to teach law has somebody who made us of his knowledge of the letter of laws during all his military career in order to break them, circumvent them, and to cover up grave crimes and compulsory criminal perpetrators ? What can one think of a faculty of law which gives a teaching job to such an individual ?
  • Does Be’er talk to his students about the numerous violations of laws which he helped cover up or justify, and the war crimes in which he was involved during his career ?
